Vilka rätter gäller vid graviditet under visstidsanställning

Hi. I am working for an Italian company in Stockholm as shop assistant since March 2016. Now I am pregnant and my contract is going to expire on the 1st of February 2018. They don't want to renovate it because they think that I am not doing my job 100% but at the same time no one told me nothing since I said them about my pregnancy. And I didnt get neither a warning letter.
And I think also that the selling are almost the same compared to those of last year, when they renovated my contract without any problems. Can they do it?

Thank you for contacting us at Fråga Juristen with your question! I would like first to congratulate you on your pregnancy. Please find hereafter my answer.

The relationship between an employer and an employee is governed by what is called in Swedish LAS (Lagen om anställningsskydd which could be translated to law for employement protection).

In your case, the employment contract that binds you and your employer is a temporary employment which will end on the first of February 2018. According to LAS (4 § 2 st. LAS), unless you and your employer have agreed on something else, the contract cannot end earlier than this date. Regardless of your pregnancy, your employer is under no obligation to neither keep you after the first of February 2018 nor to renew the contract. But your employer cannot either end your employment earlier just based on your pregnacy.
